Booking Terms & Conditions
A clear framework for inquiries, quotations, confirmations, payments, changes and travel responsibilities.
These terms apply to bookings made directly with Explore Empakai Adventures and Safaris unless a written quotation or booking confirmation expressly states different terms for a specific trip.
1. About us
Explore Empakai Adventures and Safaris is a business name registered in Tanzania under BRELA registration No. 714620. Registered proprietor: Erick Israel Mollel. Full details are in our Legal Notice.
2. Inquiry versus booking
Sending a WhatsApp message, email or planner inquiry does not create a booking. A booking is only confirmed after the itinerary, total price, included and excluded services, payment schedule and any trip-specific conditions are provided in writing and we issue or acknowledge a written booking confirmation after the required payment has been received.
3. Quotations and prices
Quotations are based on the information available when they are prepared and may be subject to availability. Park fees, accommodation, transport, third-party activities, taxes, exchange rates or other supplier costs can change before confirmation. Any material change will be communicated before you are asked to confirm the booking.
4. Payments
The deposit amount, balance due date, currency, payment method and any payment-related charges will be stated in your written quotation or booking confirmation. This website does not currently provide an online payment link. Only use payment instructions that have been confirmed to you in writing through an agreed contact channel.
5. Cancellations by the traveler
Cancellation terms can depend on the accommodation and third-party services included in your itinerary. The applicable cancellation schedule and any non-refundable supplier amounts should be stated in your written quotation or booking confirmation. If you cancel, any refund is calculated according to those agreed terms and amounts already committed to suppliers.
6. Changes requested by the traveler
We will try to accommodate reasonable changes, but changes may affect availability, route, price or supplier terms. No requested change is binding until confirmed in writing.
7. Changes or cancellation by us
Travel in Tanzania can be affected by weather, road conditions, park rules, wildlife movements, supplier availability, safety considerations, government measures or other circumstances outside reasonable control. Where a material change becomes necessary, we will aim to offer a practical alternative, reschedule where feasible, or apply the remedies stated in the confirmed booking terms and applicable law.
8. Wildlife and natural conditions
Wildlife sightings, migration locations, weather and natural conditions cannot be guaranteed. Images and destination descriptions on this website are illustrative of the type of experience available, not a promise that the same sighting or condition will occur on your trip.
9. Accommodation, transport and third-party services
Some parts of a safari are provided by independent lodges, camps, transport providers, park authorities or activity providers. Their operational rules and safety requirements may apply in addition to these terms. We will identify material third-party conditions when they are relevant to the confirmed itinerary.
10. Traveler responsibilities
You are responsible for providing accurate traveler information, complying with immigration and entry requirements, carrying valid travel documents, following safety instructions, and ensuring that the itinerary is suitable for your health, mobility and personal circumstances. You should arrange appropriate travel and medical insurance for the trip.
11. Health, visas and travel advice
General information from us is not medical, immigration or legal advice. Entry rules, vaccination requirements and official travel advice can change; travelers should verify current requirements with the relevant authorities and qualified professionals before departure.
12. Conduct and safety
Travelers must follow reasonable safety instructions from guides, drivers, accommodation providers and park authorities. We may refuse or discontinue an activity where conduct creates a serious risk to the traveler, other people, wildlife or property, subject to applicable law and the circumstances.
13. Complaints
If a problem occurs during the trip, please tell the local contact as soon as reasonably possible so there is an opportunity to address it. If the issue is not resolved, send a written complaint to molelerick03@gmail.com with the booking details and relevant information.
14. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful. Subject to applicable law and the confirmed booking arrangement, responsibility for a service provided directly by an independent supplier may rest with that supplier. Any limitation or allocation of liability specific to a booking should be set out in the written confirmation.
15. Force majeure
Neither party is expected to perform an obligation that cannot reasonably be performed because of events beyond reasonable control, such as serious natural events, conflict, government restrictions, major transport disruption, epidemic/pandemic measures or comparable events. The parties should cooperate in good faith on practical next steps and any supplier consequences.
16. Governing law
These terms and direct bookings with Explore Empakai Adventures and Safaris are governed by the applicable laws of the United Republic of Tanzania, unless mandatory law requires otherwise. The parties should first try to resolve disputes through direct written communication before pursuing formal remedies.
17. Priority of trip-specific terms
If your written quotation or booking confirmation contains specific terms that conflict with these general terms, the trip-specific written terms take priority for that booking to the extent permitted by law.
